Terms of Service

Effective October 1, 2026

Welcome to Sidequest. These Terms of Service ("Terms") are a binding agreement between you and Sidequest Events Company, LLC ("Sidequest," "we," "us") covering your use of the Sidequest website, apps, and related services (the "Service"). Our Privacy Policy explains how we handle your information and is part of these Terms.

Please read Section 16. It requires most disputes to be resolved through individual arbitration, not in court or as a class action, and explains how to opt out within 30 days.

1. Accepting these Terms

By creating an account, checking the agreement box, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service. You may use some features as a guest before signing up; these Terms apply to guest use too.

2. Who can use Sidequest

Sidequest is built for parents, guardians, and other adults who plan outings with children. You must be at least 18 years old and able to form a binding contract to use the Service. Children do not have Sidequest accounts and may not create one. If we learn that an account belongs to someone under 18, we will close it and delete its information.

3. Your account

You are responsible for your account and everything that happens under it. Keep your login secure and tell us promptly at privacy@sidequestkids.com if you suspect unauthorized access. Give us accurate information and keep it current.

Your account may belong to a shared space with other adults you invite (for example, a family member, caregiver, or teacher). The adult who creates that space is its owner. Owners control who can join and are the only members who can view or edit sensitive information such as allergies and health notes. Invite only adults you trust; members can see the plans and crew information in that shared space.

4. Information about children in your care

Sidequest lets you add basic details about children you plan outings for, such as a nickname, age, interests, and, if you choose, allergies or health notes. By adding a child's information, you confirm that:

  • you are that child's parent or legal guardian, or you have that parent or guardian's permission to add it;
  • the information is accurate to the best of your knowledge; and
  • you will add only what you need to plan outings. Please don't enter a child's full legal name, school, home address, photos of their face, or government ID.

You can edit or delete a child's information at any time. How we protect it is described in the Privacy Policy.

5. Acceptable use

Use Sidequest to plan good days out. You agree not to:

  • post, share, or collect another family's child information, including names, photos, schools, locations, or schedules;
  • harass, stalk, impersonate, or contact anyone who hasn't agreed to connect with you;
  • scrape, crawl, or bulk-download the Service or other users' content;
  • use the Service for any unlawful purpose, or to send spam or advertising;
  • probe, disrupt, or bypass our security, rate limits, or access controls;
  • reverse engineer the Service except where the law expressly allows it; or
  • use the Service or its outputs to build a competing product or train AI models.

We may remove content or suspend accounts that break these rules.

6. Your content

"Your Content" is anything you add to Sidequest: plans, notes, messages, feedback, photos, posts, and crew information. You own Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content only as needed to run, secure, and improve the Service for you and for the people you choose to share with. This license ends when you delete Your Content or your account, except for copies that other users already remixed from a post you made public, and backups kept for the limited period described in the Privacy Policy.

When you share or post a plan, you decide who sees it. Posts to followers or the public are automatically stripped of children's names, exact dates and times, private notes, and allergy information before anyone else sees them. You can revoke a post at any time.

You confirm you have the rights to anything you upload and that it doesn't violate anyone else's rights.

7. Our Service and suggestions

We own the Service, including its software, design, activity formats, and branding. We grant you a personal, revocable, non-transferable license to use the Service under these Terms. Plans Sidequest generates for you are yours to use and share for personal, non-commercial purposes.

If you send us ideas or feedback, we may use them without owing you anything.

8. AI-generated plans

Sidequest uses artificial intelligence to suggest outings, routes, activities, and packets. AI suggestions can be wrong, out of date, or unsuitable for your family. Venues close, hours change, weather turns, and events get cancelled. You are responsible for reviewing every plan and deciding whether it is appropriate and safe for the children in your care.

9. Safety, supervision, and allergies

Sidequest is a planning tool. It is not a babysitter, safety service, medical tool, or emergency service. Supervision of children is always your responsibility. Allergy and health notes are a convenience for you and the people you choose to share them with; they are not a medical record, and Sidequest does not check venues, food, or activities for allergens. Call 911 or your local emergency number in an emergency.

10. Third-party services and venues

The Service shows information from and links to third parties, such as maps, venues, event calendars, weather services, and calendar apps you connect. We don't control them, don't endorse them, and aren't responsible for their content, accuracy, availability, safety, or practices. Your use of them is governed by their terms. Visiting a venue is a transaction between you and that venue.

11. Fees

The Service is currently free. If we introduce paid features, we will show you the price and terms before you are charged, and nothing you already use will be switched to paid without notice.

12. Disclaimers

THE SERVICE AND ALL CONTENT AND SUGGESTIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE ACCURATE, SAFE, UNINTERRUPTED, OR ERROR-FREE. WE MAKE NO WARRANTY ABOUT ANY VENUE, EVENT, ROUTE, ACTIVITY, OR THIRD-PARTY SERVICE.

13. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (A) SIDEQUEST AND ITS OWNERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL; (B) WE WILL NOT BE LIABLE FOR ANY INJURY, ILLNESS, LOSS, OR DAMAGE ARISING FROM ANY OUTING, VENUE, EVENT, ACTIVITY, ROUTE, OR THIRD-PARTY SERVICE, EVEN IF SUGGESTED BY THE SERVICE; AND (C) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY AND EVEN IF WE WERE TOLD OF THE POSSIBILITY OF DAMAGE. Some places don't allow certain limits, so some of these may not apply to you. Nothing here limits liability that cannot legally be limited, such as for our gross negligence or willful misconduct.

14. Indemnity

You will defend, indemnify, and hold harmless Sidequest and its owners, officers, employees, and suppliers from any claims, losses, and costs (including reasonable attorneys' fees) arising from Your Content, your misuse of the Service, your violation of these Terms or the law, or information you add about a child without proper authority.

15. Ending your use

You can delete your account at any time in Settings or by emailing privacy@sidequestkids.com. We may suspend or end your access if you break these Terms, if we're required to by law, or if we stop offering the Service; where practical we will give notice and a chance to download your information first. Sections 6 (license survival), 7, and 12 through 18 survive termination.

16. Disputes and arbitration

Talk to us first. Before filing any claim, email privacy@sidequestkids.com with a description of the issue. Both sides will try in good faith to resolve it within 60 days.

Binding individual arbitration. If we can't resolve it, you and Sidequest agree that any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be held by video, phone, or in the county where you live. For claims under $10,000, we will pay your AAA filing fees. Either side may instead bring an individual claim in small claims court, and either side may seek court relief for intellectual property misuse or unauthorized access.

No class actions. You and Sidequest each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. If this class waiver is found unenforceable for a claim, that claim will proceed in court, not in arbitration.

Opt out. You can opt out of this arbitration agreement by emailing privacy@sidequestkids.com with the subject "Arbitration Opt-Out" and your account email within 30 days of first accepting these Terms.

17. Governing law

These Terms are governed by California law, without regard to conflict-of-law rules, and the Federal Arbitration Act governs Section 16. Any court proceedings not subject to arbitration will be held in the state or federal courts in Los Angeles County, California.

18. General terms

We may update these Terms. For material changes we will notify you by email or in the app at least 14 days before they take effect; continuing to use the Service afterward means you accept them. These Terms and the Privacy Policy are the entire agreement between us. If a provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them in a merger, acquisition, or sale of assets, subject to the commitments in our Privacy Policy. We are not liable for delays caused by events beyond our reasonable control.
